신용장통일규칙상 운송서류의 수리요건에 관한 연구

현행 신용장통일규칙은 해상선하증권, 유통불능 해상운송장, 용선계약선하증권, 복합운송서류, 항공운송서류, 도로/철도/내수로 운송서류, Courier(급사)/우편수령증 등 7개 운송서류 각각에 관하여 수리요건을 규정하고 있다. 그런데 이의 해석을 둘러싸고 오해가 빈발하고 있으며, 이로 인하여 원활한 무역거래의 지장을 초래하고 있다.
따라서 본고에서는 각각의 운송서류별로 수리요건을 고찰함으로써 실무상 이의 해석과 관련한 오해를 해소하는데 일조하고자 한다. 이를 위하여 해상선하증권의 수리요건에 대하여 먼저 고찰하고, 다음에 각 운송서류들의 해상선하증권과의 차이를 중심으로 각 운송서류별 수리요건을 고찰한다.

Current UCP 500 stipulate the acceptance requirements of seven kinds of transport documents-marine/ocean bill of lading, non-negotiable sea waybill, charter party bill of lading, multimodal transport document, air transport document, road, rail or inland waterway transport documents, courier and post receipts.
By the way, there have been many misunderstandings in interpreting the acceptance requirements of transport documents. Therefore, this study will help to solve the problems in interpreting of transport documents.
