본 연구는 지방정부와 주민간에 발생하는 분쟁이 급격히 증가하고 있고, 갈등과 분쟁의 정도가 심각성을 더해가고 있고, 동일한 유형의 환경분쟁이 지역별로 계속적 · 반복적으로 발생하고 있어서 그 해결의 중요서이 큰바 갈등과 분쟁을 사전에 예방할 수 있는 제도적 장치나 구조가 필요하다는 점에서 본 연구의 목적이 있다.
본 연구에서는 선행연구를 개관하고, 현행 분쟁해결제도를 비판적으로 검토하고, 지방정부와 주민간의 갈등분쟁상황을 보다 실질적으로 해결하기 위하여 대안적 분쟁해결방안을 모색하였다.

The purpose of this paper is to explore an alternative dispute resolution based on the negotiated approach as an preliminary step againest environmental dispute resolution in local area. And this paper focuses on the local residents' participation in locally unwanted public facilities based on negotiated approach, which can not only solve the confilicts peacefully and give benefits to every part but also contribute to the cloacl autonomy unlike the previous methods. However, negotiation has some shortcomings. Therefore we have to search another method such as mediation, arbirtation to make up for defect of negotiation. Of course, there are, and always have been, three parctical alternatives to litigation howere, neither mediation nor arbitration can be invoked unless both sides first negotiate an agreement to use either of those techniques. The most important thing is that negotiation is not only an essential prelude to mediation and arbitration. It underlies and informs our entire system of conflict resolution. And all disputes, including disputes over invoking mediation and arbitration, can be resoluved through negotiation.
