언론인 저작물에 나타난 취재행위의 형사법적 위법 가능성에 관한 연구

  • 현장의 경험을 담은 언론인들의 자전적 저작물은 후배 언론인, 혹은 예비 언론인들에게 답습을 위한 교범처럼 읽히기도 하고 윤리 헌장으로서 기능하기도 한다. 언론인 저작에는 그들의 삶과 취재보도 현장, 그리고 언론윤리에 대한 상세한 설명이 깃들어 있기 때문인데, 특히 대학과 현업에서 언론윤리 법제에 대한 교육이 제대로 이뤄지지 못하고 있는 한국의 경우에 언론인 저작물의 비중은 더욱 크다고 할 수 있다. 그런데 언론인의 저작물 중 일부는 위법의 가능성이 있는 취재보도 경험들을 윤리적 정당화나 반성 없이 나열하고 있고 취재보도의 정석인 것처럼 강변하는 경우도 적지 않다. 취재보도의 준칙을 벗어나 인권을 유린하고 사인의 재산에 손괴를 가한 행위 등이 국민의 알권리 충족이란 이름표를 달고 소개되고 있기도 하다.
    언론인 저작물에 나타난 취재행위들의 위법 가능성과 윤리적 정당화 여부를 분석하고 평가하는 작업은 한국의 언론환경을 개선해 가는 데 실질적 기초가 될 것이다. 이에 연구자는 언론학을 전공하는 학생들에게 비교적 널리 읽히는 저명한 저작물 11권을 대상으로 형사법상 위법의 가능성이 있는 취재행위들의 유형과 시기별 특성 등을 중점적으로 분석하였다. 분석결과, 언론인 저작물은 평균 76.7페이지당 한 건씩 위법의 가능성이 있는 취재보도 행위를 소개하고 있으며, 대부분 취재의 불가피성이나 윤리적 정당화가 수반되지 않고 있었다. 또 국민들의 알권리를 충족시킨다는 명분에도 불구하고 '사적인 공간에서 사인들에 대한' 위법성 취재행위가 두드러지게 제시되었으며, 거짓말과 잠입, 몰래카메라 등에 의한 '위계와 기만' 취재가 분석 사례의 대부분을 차지하였다. 이는 취재과정에서 발생하는 인격권과의 갈등이 정보제공 환경을 기밀주의에서 비롯하고 있다는 주장과 상당 부분 상치하며, 언론인 저작물에 게재된 위법성 취재행위들은 대부분, 현행의 언론관련 법제화에서 법적 처벌을 받을 가능성이 매우 높은 것으로 분석되었다. 이에 연구자는 몇 가지 제언을 결론 부분에 첨언하였다.

  • A Journalists' autobiography has influence on would-be journalists as the reference framework for them to judge whether certain newsgathering activities are socially allowed or not. Nevertheless, some of the autobiographies overtly print out the illegal activities in newsgathering without ethical justification. Furthermore, the activities which invade the privacy and harm the property of private individuals are described as if they were excused for the sake of the people's rights to know.
    The purpose of this study is to analyze the criminal illegality of newsgathering activities and to find out the typical characteristics of the activities put in journalist's autobiography. This study has four research questions: 1) Which surroundings did the criminal illegality of newsgathering activities happen under? 2) Were there the significant differences on the characteristics of journalist's illegal activities with the passing of time? 3) Have these activities been punished for infringing the criminal law? and 4) which crimes could be applied at the cases under the existing system of criminal law?
    46 cases describing illegal newsgathering activities were selected out of 10 journalists' works and analyzed in this study. The findings of this study can be summarized as follows: 1) There was a case that could be punished for infringing the criminal law per 76.7 pages. And almost all the activities didn't go with the ethical justification or the inevitability of the illegal newsgathering. 2) There was a lot illegal newsgathering activities in Journalists' autobiography. In particular, illegal cases against a private individual in the private jurisdiction(i don't understand) amounted to 65.2% of total cases. 3) Deceptive newsgathering activities such as lying, fraud, misrepresentation, and hidden camera recording and so on formed 84.8% of total cases. The activities of journalists to misrepresent and deceive their source were overtly introduced into journalist's works as the necessary methods for reporing. 4) The possibility that those activities would be punished for breaking the law is very high under the current system of criminal law. The lawsuits against journalists or media have been increasing since 1990 and the rate of a plaintiff winning in those lawsuits is approximately 70%. This shift of a legal environment surrounding the press is enough to bring journalists or future journalists to their senses, In other words, they should recognize that legally and ethically questionable newsgathering activities, especially instrusiv nd deceptive newsgathering practies connot be justified any more.
