Since the launch of the WTO, food safety regulations have been revised in major developed countries, and then international disputes are going to expect due to the harmonization of regulatory standards between the countries and the transition of post-management systems. The purpose of this study is to compare and analyze related legal texts of WTO, mega FTA, EU, USA, and China on safety standards of Eco-friendly foods such as GMOs and organic foods, and then to discuss on food safety policy and FTA in Korea. The details of this study are as follows.
First, the difference in food safety regulations, especially between the United States, the EU and China, can cause serious problems in terms of harmonization of international standards. The United States and the EU have traditionally a number of regulations on food safety, and China has been strengthening food safety regulations in recent years. In the EC-Hormones case, we confirmed that the United States and the EU have established a conflicting social regulatory system, considering that the regulations, standards, recall system, traceability system, HACCP (HACCP) related to food safety regulation are favorable to developed countries with high level of science and technology, Developing countries with low levels of science and technology are need to prepare for domestic and foreign laws and regulations related to the protection of the environment and health of the WTO where the value of free trade prevails. Compared with studies on some well-known Agreements such as trade remedies, on food safety and hygiene, which are relatively underdeveloped, will satisfy the objective of balanced development of the international trade law and systematic research in this area. Therefore it is necessary to analyze the regulations of each country on food safety and to study the policy trends related to food safety more intensively in practical field analysis rather than just law. Korea's regional economic integration strategy, which started late compared to developed and competitive countries, should pursue as much free trade as possible within the scope of the current trade regulation measures under the WTO system, while at the same time establish strategies to protect domestic industries and public health. In China, recently the issue of food safety in food products originating has emerged around the world. Therefore, China's food safety policy was not established until 2007. The main goals of this policy are to oversee food and drug supervision, improve management system, complete legal system, improve administrative capacity, prepare food and drug safety standards, and punish for selling fake foods and drugs in next 5 years. Imported food, food additive and related products must meet national standards for food safety in China and after obtain customs clearance from immigration inspection and quarantine agency and customs clearance based on proof of customs issued.These efforts are aimed at raising awareness of Chinese food, but it is possible to be a strict application standard for imported food in the future. Thus it conduct further practical studies by analyzing the differences between Chinese and Korean legal system, it is considered that further practical study can be done.
The purpose of this study suggests the appropriate countermeasures to the Korean government and companies on the new major issues of food - related trade measures and the National Health Protection - through examining the opposition factors derived from the review of laws and policies related to eco-friendly food safety regulations and the harmonization of international standards,
