세계화의 진전에 따라 국가간 규제차이가 국제무역과 투자의 중대한 장애물로 부각되고 있다. WTO체제의 등장과 더불어 이 문제에 대한 논의가 OECD 등을 중심으로 계속되고 있으나 아직 어떤 뚜렷한 행동기준이나 준칙이 마련되지는 않고 있다. 이 글은 먼저 이런 시점에서 국가간 규제차이를 문제삼는 것이 과연 정당한지, 어떤 형태로든 국가간 규제의 조화나 협력이 불가피한 바, 그 추진방안으로 논의되고 있는 규제조화와 상호인정은 각기 어떤 장단점이 있는지, 그리고 앞으로 어떤 방식이 국가간 규제협력의 주류를 형성하게 될지를 검토하고 있다. 저자는 상호인정이 개별국가의 규제정책의 자율성 존중, 협상의 상대적 용이성, 대응성과 신축성 등 여러 측면에서 규제조화보다 유리한 점이 많아 이 방식이 주로 사용되게 될 것이라고 전망하고, 우리 나라가 이런 추세에 능동적으로 대응하고 동참할 수 있기 위해서는 현재의 규제개혁체제를 시급히 재정비할 필요가 있다고 주장하고 있다.

As the globalization trend accelerates, regulatory differences among countries have increasingly come to be identified as a major obstacle hindering further integration of world market. With the emergence of the WTO, debates on the necessity and mode of international regulatory cooperation are gathering heat especially at the relevant committees of the OECD. No concrete rules of regulatory conduct or principles, however, have yet been agreed upon. This paper aims at examining the legitimacy of harmonization claims, comparing the two major approaches to international regulatory cooperation--regulatory harmonization and mutual recognition, and then making predictions about which of the two methods would predominate. On the judgement that mutual recognition excels harmonization in such respects as honoring the national policy autonomy, the ease of negotiation, and flexibility, and finding that many advanced countries have already chosen to follow this path, the author urges Korean government to take special notice of recent developments and to modify the guiding principles governing the current regulatory reform processes in a fashion to review and reform existing regulations with renewed and explicit concern for their potential trade impacts.
