The recent economic downturn that Korea is facing is not a temporary phenomenon caused by the global economic crisis, but a structural long-term recession, the New Normal era is heralding the emergence of the New Normal era. The New Normal era is represented by the stuck-up of low growth, high uncertainty, rapid technological change, and the free movement of capital and labor, which will call for a different survival strategy from the 20th century industrial society, from individuals and businesses to the government. This new normality means the emergence of a new global social environment that is not only temporary economic phenomena confined to certain regions but also complicatedly linked to long-term and diverse social phenomena. The global economy is striving for continued growth to create jobs and develop industry amid low interest rates, low raw material prices and low oil prices. For the continued growth and development of the Korean economy in the New Normal era, investment is revitalized, employment is created, and a corresponding strategy is called for to find economic vitality.
First of all, we need to change the way we look at the world from the perspective of the existing economic In other words, in the New Normal era, instead of gaining pleasure through ownership, a strategy is needed to make sharing a happy life, and to try to increase the happiness index rather than exerting efforts to improve a country's quality of life. Next, in order to overcome low growth by creating new employment, we must integrate creativity based on science and technology with social culture to expand the driving force of high value. In order to achieve qualitative growth beyond the limitations of past elemental input-type growth, a cooperative strategy that strengthens innovation based on creativity is needed. Therefore, the cooperative system of the labor union, which is treated by innovative workers and duly compensated, and the system for coexisting businesses and society should be reorganized. This is where the social role of the enterprise is important, and the discussion of the social responsibility of the enterprise is urgently needed.
Corporate social responsibility (CSR) refers to 'the company's consideration of the interests of its shareholders and companies as well as the interests of its various stakeholders, such as the state and community, together', which is not a fixed concept because it is defined in a variety of ways as society changes. The traditional CSR theory was negatively reviewed in the face of the conflict between shareholderism and stakeholderism, which is the essential argument of the enterprise. But the strategic social responsibility theory in response to the New Normal era should focus on how to implement CSR in reality rather than on abstract discussions on the essentials of enterprises. So far, efforts to realize CSR through autonomous regulation have been limited. Thus, in the New Normal era, the legal system needs to be reorganized to spread the CSR more aggressively.
In this study, CSR is not a guiding principle in interpretation, but a counter strategy in the New Normal era, which seeks to standardize new types of corporate responsibility. First, with regard to the necessity of the New Normal era and CSR proliferation, the coming and problems of the New Normal era, the need for the spread of CSR as a response strategy and response strategy of the New Normal era is reviewed. Second, the legal system related to the spread of CSR in major countries is derived by comparing and analyzing the contents of the CSR related legislation in the UK and the US, and the CSR regulation in India's company law. Third, based on the comparative data of the CSR law system, we are going to propose a plan for the readjustment of Korea's CSR law system in response to the New Normal era.
